  1. .TX1 *** OPERATION OF THE RANCH BY TENANT, PROVISIONS ***********
  2. {!P}.  LIVESTOCK PRODUCTION.  The LESSEE shall stock the farm 
  3. with livestock of his choosing, except he shall not stock permanent 
  4. native  pastures  with more than {MAXIMUM_STOCK} animal units. 
  5. An animal unit consists of one of the following:  (a) one cow 
  6. and nursing calf, (b) one horse, or (c) one thousand pounds of 
  7. weaned calves.

  9. {!P}.  GENERAL MAINTENANCE.  LESSEE will maintain the ranch during 
  10. his  tenancy  in as good condition as at  the  beginning,  normal 
  11. wear, depreciation and damages from causes beyond LESSEE'S control 
  12. excepted.  He shall occupy and use the ranch in a manner to protect 
  13. LESSOR'S claim of title as against all adjoining  owners.
  14.  
  15. {!P}.  GOOD HUSBANDRY.   LESSEE also agrees to operate the ranch in 
  16. an  efficient manner,  using good husbandry to conserve  LESSOR'S 
  17. property.  LESSEE will use due diligence to prevent noxious weeds 
  18. from  spreading and will keep the weeds and grasses under control 
  19. so as not to contaminate the ranch with undesirable vegetation so 
  20. far as possible.   In the treatment of noxious plants with 
  21. chemicals, with LESSOR'S prior oral agreement, the LESSOR and 
  22. LESSEE shall share equally in the cost of materials.  The cost of 
  23. application shall be borne by LESSEE.  In the event weed control 
  24. measures are undertaken by LESSEE for the purpose of harvesting a 
  25. grass seed crop, LESSEE shall bear the cost of all materials used 
  26. for such purpose unless an agreement is reached with LESSOR for 
  27. participation in such grass seed crop.
  28.  
  29. {!P}.  CROPPING  PRACTICES.  Without the specific approval of 
  30. LESSOR, LESSEE will not (a) plow permanent pastures, (b) cut live 
  31. trees for sale or personal use but will use only dead timber as 
  32. designated by LESSOR, (c) allow  livestock other than his own on 
  33. ranch land,  (d) burn or remove straw or grass grown on the ranch, 
  34. (e) pasture new seedings of legumes and  grasses in the year they 
  35. are seeded, nor (f) plant legumes on land not known to be thoroughly 
  36. inoculated without first inoculating the seed.
  37.  
  38. {!P}.  LIVESTOCK PRACTICES.  LESSEE will follow health and 
  39. sanitation measures and guard against disease in his livestock.
  40.  
  41. {!P}.  WASTE.   LESSEE will not commit waste on or damage to the 
  42. ranch and will use due care to prevent others from doing so.
  43.  
  44. {!P}.  FIRE PROTECTION.  LESSEE will not house automobiles, 
  45. motor trucks or any motorized machinery or property on the leased 
  46. premises.
  47.  
  48. {!P}.  MAINTENANCE OF IMPROVEMENTS.  LESSEE will maintain 
  49. buildings, fences and other improvements in as good repair and 
  50. condition as they are when he takes possession, and in as good 
  51. repair and condition as they may be during the term of this lease 
  52. except for  ordinary  wear and tear, loss by fire, or unavoidable 
  53. depreciation or destruction.
  54.  
  55. {!P}.  MATERIALS  AND LABOR.  LESSOR will furnish materials 
  56. for capital  improvements on the ranch not exceeding, in any event, 
  57. the  cost of $500 during any one year without the  prior  written 
  58. agreement  of LESSOR.  LESSEE will perform all labor for  normal 
  59. maintenance and repair.
  60.  
  61. {!P}.  ADDITIONAL IMPROVEMENTS.  LESSEE will not without written 
  62. approval  of  LESSOR (a) erect or permit to be  erected  on  the 
  63. ranch any non-removable structure or building, or (b) incur  any 
  64. expense to the LESSOR for such purpose.
  65.  
  66. {!P}.  CONSERVATION PRACTICES.  LESSEE will control soil erosion 
  67. as completely as practicable by filling in or otherwise controlling 
  68. small washes or ditches that may form.
  69.  
  70. {!P}.  CONSERVATION STRUCTURES.  LESSEE will keep in good repair 
  71. all  open  ditches, preserve all established  water  courses  and 
  72. refrain  from  any  operation or practice that  cause  injury  or 
  73. damage to the leased premises.
  74.  
  75. {!P}.  GOVERNMENT PROGRAMS.  The Ranch will be operated in 
  76. compliance with Government programs including the planting of any 
  77. crops required to maintain existing crop allotments.  LESSEE agrees 
  78. to maintain adequate cover on any acreage used as layout acreage for 
  79. crops on other farms to prevent erosion thereof and to tend  such 
  80. acreage to prevent the growth of weeds or trees on such land.

  82. .TX2 *** CONSERVATION RESERVE PROGRAM ACREAGE INCLUDED **********
  83. {!P}.  CONSERVATION  RESERVE PROGRAM ACREAGE.  {CRP_ACRES} Acres 
  84. of crop land included on the leased premises is leased to LESSEE 
  85. subject  to  all the terms and conditions  of  the  Conservation 
  86. Reserve Program Contract No. {CRP/CONTRACT_NO.} between LESSOR 
  87. and the Commodity Credit Corporation dated {CRP/CONTRACT_DATE}, a 
  88. copy of which  is attached to and made a part of this agreement.  
  89. LESSEE is  hereby assigned the right to receive all of the rent 
  90. and all cost-share  payments  under  said agreement and, unless 
  91. LESSEE elects not to become a successor-in-interest under said 
  92. contract, he  agrees to undertake and perform all requirements of 
  93. LESSOR thereunder and to comply with all the terms and conditions 
  94. of said  contract.  If LESSEE elects not to become  a  successor-in-
  95. interest under the provisions of paragraph 21 of said contract or 
  96. fails to comply with such agreement, LESSEE agrees to  pay  all 
  97. damages,  costs and penalties, including any  liquidated  damages 
  98. due the Commodity Credit Corporation for such breach.

  100. .TX3 *** CONSERVATION RESERVE PROGRAM ACREAGE EXCLUDED **********
  101. {!P}.  CONSERVATION RESERVE PROGRAM ACREAGE.  {CRP_ACRES} Acres 
  102. of crop land included on the ranch property described above is subject 
  103. to the terms and conditions of a Conservation Reserve Program 
  104. Contract No. {CRP/CONTRACT_NO.} between LESSOR and the Commodity 
  105. Credit Corporation dated {CRP/CONTRACT_DATE} and such acreage is 
  106. specifically excluded from this lease by mutual agreement of the 
  107. parties.  LESSEE agrees to cooperate with LESSOR to prevent any 
  108. violation of the terms of that agreement of which LESSOR agrees 
  109. and undertakes to perform during the term of this lease.
